The American Board of Professional Psychology (“ABPP”) believes that the protection and privacy of your personal data and non-personal data (collectively “data” or “your data”) is paramount, and we value your right to privacy. ABPP strives to protect data that we collect through your interaction with the ABPP website (“ABPP Website”), ABPP social media tools (“ABPP Social Media”), and other digital and non-digital spaces where ABPP may collect data (collectively, “ABPP Digital Assets”).

This Privacy Statement applies to all individuals who interact with ABPP Digital Assets, including specialists, applicants/candidates in the certification process, and general website visitors.

Data you provide to us through your use of ABPP Digital Assets helps to inform ABPP about how best to provide you with a fulfilling user experience as it relates to our mission of promoting excellence in professional psychology. Our goal is to ensure that your data are secure, and that ABPP only uses your data subject to the terms and conditions set forth below.

ABPP is committed to working with you to obtain a fair and rapid resolution of any queries, complaints, or disputes about privacy. If you have any questions or comments about our Privacy Statement, Cookie Policy, or our information collection and data protection practices, please contact us.

By using ABPP Digital Assets, you consent to the terms and conditions of this Privacy Statement and to ABPP processing your data for the purposes stated below. If you do not agree to these terms and conditions, please understand that your use of ABPP Digital Assets may be limited. In some instances, you may not be allowed access to areas that require ABPP to verify you as an authorized user (for example, logging into your ABPP account or accessing certification records).

Data ABPP Collect

You provide data to us to create your account, apply for certification, maintain your certification, or transact business with us. We collect data from all visitors (“Users”) to ABPP Digital Assets to interact with you. The following are examples of the types of data we collect:

Personal Data

“Personal data” are data that you provide to us, or that we may otherwise collect, that identifies you directly. This also includes information that is associated with you and could potentially identify you, including when combined with other information from or about you. We will not collect or use personal data except as stated in this Privacy Statement. Personal data may include, among other things, name, postal address, telephone number, email address, professional credentials, licensure information, payment and billing information, or a combination of these and other data.

Certification and Examination Data

In connection with the ABPP certification process, we may collect additional data related to your candidacy and professional qualifications. This may include educational background, supervised experience records, practice samples, examination scores, and other materials submitted as part of the certification or recertification process. These data are used solely to administer the certification process and to maintain the integrity of the ABPP credential.

Non-Personal Data

“Non-personal data” may be technical information or demographic information, such as your zip code, geolocation data, or professional interests. Non-personal data may be information that is automatically collected through, for example, the use of cookies. Non-personal data do not identify you personally but may be tied together with other data to identify you. Examples of non-personal data collected via ABPP Digital Assets include:

  • Internet Protocol (IP) address — Your IP address is a number that lets computers attached to the Internet know where to send you data, such as the webpages you view. We use this information to deliver our webpages to you upon request, to tailor ABPP Digital Assets to the interests of our Users, and to measure traffic within ABPP Websites.
  • Cookies — ABPP Websites use “cookies” to improve functionality and usability. We use this information for planning, tracking, and to improve the technical functions of our sites and products. By using ABPP Digital Assets, you are consenting to our use of cookies in accordance with the terms of this Privacy Statement.

Automatically Collected Data

When you visit ABPP Digital Assets, we may automatically collect data about you using cookies. These data include the browser or operating system that you use, your IP address, and the date and time you have viewed certain pages on ABPP Digital Assets. Please see the “Cookies” section below to find out more about how we use cookies and similar technologies.

How ABPP Uses Your Data

We may use your data to contact you, provide support for your certification, administer examinations, conduct surveys, and personalize our services to you. We use personal data collected on ABPP Digital Assets in the following ways:

  • To provide specialist- and applicant/candidate-related services;
  • To administer the ABPP certification, recertification, and examination processes;
  • To deliver services, such as educational programs, information, or newsletters you request or purchase;
  • To alert you to important updates, upcoming deadlines, and other new services from ABPP;
  • To process your order and, if necessary, to contact you regarding the status of your order;
  • To ensure our websites are relevant to your needs;
  • To help us create and publish content most relevant to you;
  • To request your feedback about your experience with ABPP;
  • To notify you about a material change to this Privacy Policy, if necessary;
  • To allow you access to limited-entry areas of ABPP Digital Assets; and
  • For other business purposes that help optimize your experience as you interact with ABPP Digital Assets.

Cookies

Cookies are used to recognize users when they come back to our site, to learn about which pages are most visited, and to assist with sign-on across ABPP Digital Assets.

Cookies are text files sent by web servers to web browsers and are stored on the user’s computer or mobile device. Cookies contain data about the user’s activities on a website and can be used by web servers to identify and track users as they navigate different pages on that website and identify users returning to that website.

Cookies may be either “persistent” or “session” cookies. ABPP uses persistent cookies to enable our website to recognize you when you visit or return to an ABPP Website. Persistent cookies will remain stored on your computer until you delete them or until they expire automatically. Session cookies are temporary cookies that expire at the end of a web browsing session. ABPP uses session cookies to keep track of you while you navigate ABPP Digital Assets.

How ABPP Uses Cookies

ABPP Digital Assets use data obtained from cookies for the following purposes:

  • To recognize the user’s computer when the user visits the website;
  • To track some user actions only during the current website session;
  • To improve the usability of ABPP Digital Assets;
  • To analyze the use of ABPP Digital Assets;*
  • To assist ABPP with administering ABPP Digital Assets; and
  • To share ABPP Digital Assets user data with our third-party vendors, as described in this Privacy Statement.

*We use Google Analytics to analyze the use of ABPP Digital Assets. We do not knowingly permit other third-party advertisers or tracking services to set cookies through ABPP Digital Assets. Google Analytics generates statistical and other information about website use by means of cookies stored on users’ computers. Managing Your Cookie Settings

Most browsers allow you to control cookies through their settings preferences. However, if you limit the ability of websites to set cookies, you may limit your overall user experience, since it will no longer be personalized to you. It may also stop you from saving customized settings like login information.

Google Analytics Advertising Features

ABPP uses certain Google Analytics Advertising Features, which contain third-party cookies. ABPP follows the Google Analytics policy requirements. The specific Google Analytics Advertising Features that ABPP uses include only the following: Google Display Network Impression Reporting, Google Analytics Demographics and Interest Reporting, and Integrated Services that require Google Analytics to collect data via advertising cookies and identifiers. Release of Data to Third Parties

Important Notice Regarding Third-Party Sharing: ABPP may share certain personal data with partner organizations and commercial vendors as described below. You have the right to opt out of certain types of sharing. See the “Your Choices Regarding Third-Party Sharing” section below for instructions on how to exercise this right.

Personal data collected as a function of ABPP Digital Assets will not be released to third parties except to further the purpose for which you provided the data and in the following instances:

  • To fulfill a service to you, including answering questions or completing an order;
  • To unaffiliated third-party service providers, agents, or independent contractors who help us maintain our sites and provide other administrative services to us (including, but not limited to, order processing and fulfillment, providing customer service, maintaining and analyzing data, and sending communications on ABPP’s behalf). We seek to ensure that these unaffiliated third parties will not use your personal data for any purpose other than to provide the administrative services for which they are responsible;
  • To affiliated ABPP specialty boards as necessary to administer specialty certification processes. Specialty boards are bound by data use obligations consistent with this Privacy Statement;
  • To partner organizations (such as APA, ASPPB, The Trust, National Register of Health Service Psychologists, Coalition of Psychology Practice Organizations, or other professional psychology organizations) for purposes related to the advancement of professional psychology. You may opt out of this type of sharing at any time (see “Your Choices Regarding Third-Party Sharing” below);
  • To commercial vendors or sponsors, only when you have had a clear opportunity to opt out and have not done so (see “Your Choices Regarding Third-Party Sharing” below). ABPP does not sell your personal data to third parties;
  • To complete your purchase. If you make a purchase on ABPP Digital Assets, we may collect your payment information and provide it to third parties as necessary to complete your purchase (for example, to process your credit card);
  • To comply with the law or in the good-faith belief that such action is necessary to conform to the requirements of law, comply with legal process, or protect and defend the rights or property of ABPP;
  • To third parties as part of any corporate reorganization process, including mergers, acquisitions, or sales of all or substantially all our assets; and
  • To track and analyze non-identifying and aggregate usage and volume statistical data from our Users and provide such data to third parties.

Your Choices Regarding Third-Party Sharing

ABPP provides you the opportunity to opt out of the sharing of your personal data with partner organizations and commercial vendors. To exercise your opt-out right, please contact ABPP in writing at the contact information provided below, or update your preferences through your ABPP website account if that option is available. Your opt-out request will be processed as promptly as possible.

Please note that opting out of third-party sharing does not affect sharing with specialty boards or service providers that is necessary to administer your certification, nor does it affect sharing required by law.

Specialist Directory

ABPP maintains a public directory of specialists on the ABPP website. Specialists’ names and specialty certifications are listed in the directory by default, but specialists have the option to opt out of being listed or to selectively suppress specific directory information by editing their listings.

Important: The ABPP specialist directory is provided as a professional resource for the public to verify credentials and locate board-certified psychologists. Unsolicited commercial use of directory information is strictly prohibited. Specifically: (1) sending unsolicited emails or other communications regarding products or services to individuals listed in the directory; (2) adding listed specialists to any email list or distribution list without their express consent; and (3) any other form of advertising or solicitation directed at directory listings are all explicitly prohibited. ABPP reserves the right to take action against individuals or organizations that misuse directory data.

The prohibition on commercial use of directory data applies regardless of whether you have separately opted out of third-party data sharing. Directory data accessed through ABPP’s website may not be harvested, scraped, or compiled for commercial use.

Third-Party Websites and Advertisers

ABPP Digital Assets may provide you with links to other websites. In the event you choose to access such websites, ABPP is not responsible for any actions or policies of those sites. The third party’s Privacy Policy, Cookie Policy, or security practices may differ from ABPP’s. ABPP neither assumes responsibility for, nor does it control, endorse, or guarantee any aspect of your use of the linked site. We recommend that you check the Privacy Policy and other pertinent security practices of such a party before providing personal data to it.

ABPP may also permit advertisers, third-party ad networks, or other advertising companies to serve advertisements on ABPP Digital Assets. Such companies may gather data about your visit to ABPP Digital Assets (through cookies, web beacons, and other technologies) to enable them to market products or services to you and to monitor which ads have been served to your browser. Please note that this policy does not cover the collection and use of data by such advertising companies.

Opt-Out of Communications

ABPP communicates with users on a regular basis via email. For example, we will use your email address to contact you regarding certification renewal and fees, ABPP events, to confirm a request you have made, to send you notice of upcoming deadlines, and to send notices and other disclosures as required by applicable rules. Generally, specialists and candidates cannot opt out of these communications since they are necessary to keep them informed of specific information regarding their certification status and required actions.

ABPP provides you the opportunity to opt out if you do not want to receive other types of communications from us, such as messages or updates regarding new services and products, or if you do not want us to share your personal data with certain third parties as described above. For emails, you may opt out by clicking the “unsubscribe” link within the text of an email. We will process your request to unsubscribe as soon as possible, but please be aware that in some circumstances you may receive a few more messages until the unsubscribe is processed.

Your Choices and Obligations

Data Retention

We keep your data for as long as you are a specialist, candidate, or active user of ABPP Digital Assets, and as required by law. We retain your data while your certification is active or as necessary to continue to provide services. This includes data you or others provided to us and data obtained from your use of ABPP Digital Assets. ABPP retains information only as long as necessary to accomplish the business purpose for which it was collected and to comply with its legal and contractual obligations. After that period, ABPP securely disposes of information or converts it into non-personal information by aggregating, de-identifying, or otherwise anonymizing it. There may be some instances where we retain non-personal data in a depersonalized or aggregated form.

Rights to Access and Control Your Personal Data

You may access, change, or delete your data if you are a current specialist or candidate by contacting us. We offer you settings to control and manage your data through your ABPP website account where available. For personal data that we have about you:

  • Delete Data: You can ask us to erase or delete all or some of your data (for example, if you resign your certification) and we will work to honor all requests in a timely manner. In some instances, we may not be able to delete your personal data in order to comply with applicable laws (for example, it may be necessary to keep financial records of a transaction with you, or to maintain records documenting a specialist’s certification history).
  • Change or Correct Data: You can edit some of your data through your ABPP website account. You can also ask us to change, update, or fix your data in certain cases, particularly if it is inaccurate.
  • Object to, or Limit or Restrict, Use of Data: You can ask us to stop using all or some of your data, subject to our legal obligations.
  • Right to Access and/or Take Your Data: You have the right to see your data and, upon request, we will work to provide the most complete set of your data and a secure way to transfer it.

Please note that ABPP will not delete historical data that references your service to ABPP or its governance, nor will ABPP delete data related to certifications that have been publicly awarded.

Website Security

No data transmissions over the Internet may be guaranteed to be 100 percent secure. Consequently, we cannot ensure or warrant the security of any data you transmit to us, and you understand that any data you transfer to ABPP is done at your own risk. However, ABPP uses website security measures consistent with current best practices to protect its website, email, and other systems. These measures include technical, procedural, monitoring, and tracking steps intended to safeguard data from misuse, unauthorized access or disclosure, loss, alteration, or destruction.

Credit card data are transmitted using Secure Socket Layer (“SSL”) encryption or Transport Layer Security (“TLS”). Specialist and candidate data is a high priority, and we use our own protective measures as well as the capabilities of our software and hardware vendors.

In the event of a data security incident that involves your personal data, ABPP will notify affected individuals as required by applicable law and will take prompt steps to contain and remediate the incident. As appropriate and necessary, ABPP will notify the relevant authorities of incidents of misuse or unauthorized access.

State Privacy Rights

California

California Civil Code Section 1798.83 permits our visitors who are California residents to request certain information regarding ABPP’s disclosure of personal data to third parties for their direct marketing purposes. To make such a request, please contact us using the information below.

Other U.S. States

Residents of certain other U.S. states (including but not limited to Virginia, Colorado, Connecticut, and Texas) may have additional rights with respect to their personal data under applicable state privacy laws, including rights to access, correct, delete, and obtain a copy of their data, and to opt out of certain processing activities. ABPP is committed to honoring these rights. To exercise any applicable rights, please contact us using the information below.

Children’s Privacy

ABPP Digital Assets and the services ABPP provides are not directed to or intended for individuals under the age of 18. We do not knowingly collect personal data from minors. If we become aware that a minor has provided us with personal data, we will take steps to delete such information. If you become aware that a minor has provided us with personal data, please contact us.

EU Data Subjects

This section applies if you are an EU data subject (for these purposes, reference to the EU also includes the European Economic Area countries of Iceland, Liechtenstein, and Norway and, where applicable, Switzerland).

ABPP is the data controller for processing personal data provided to us through ABPP Digital Assets. Subject to applicable law, you have the following rights in relation to your personal data:

  • Right of access: You may ask us whether we are processing your personal data and, if so, request a copy.
  • Right to rectification: If your personal data are inaccurate or incomplete, you are entitled to have them corrected or completed.
  • Right to erasure: You may ask us to delete or remove your personal data in certain circumstances.
  • Right to restrict processing: You may ask us to restrict the processing of your personal data in certain circumstances.
  • Right to data portability: You have the right to obtain your personal data from us in a structured, commonly used, and machine-readable format.
  • Right to object: You may ask us at any time to stop processing your personal data for direct marketing or where we are relying on a legitimate interest.
  • Right to withdraw consent: If we rely on your consent to process your personal data, you have the right to withdraw that consent at any time.
  • Right to lodge a complaint: If you have a concern about our privacy practices, you can report it to the data protection authority authorized to hear those concerns.

For EU User Consent regarding Google advertising features, ABPP follows the Google EU User Consent Policy.

Assignment

If all or part of our assets are sold or acquired by another party, or in the event of a merger, you grant us the right to assign the personal and non-personal data collected via ABPP Digital Assets, subject to applicable law.

Changes in Our Privacy Policy

ABPP reserves the right to make changes to our Privacy Policy at any time and for any reason. Any changes to our Privacy Policy will be posted on this page and in other places we deem appropriate so that you are always aware of our policies. We may also contact you by email with material changes. The “Last Updated” date at the top of this document will reflect the date of any revisions.
